NEW YORK - «La pena di morte è nel caos», annuncia il Washington Post in prima pagina. «Una casa farmaceutica blocca le esecuzioni negli Stati Uniti», fa eco il Wall Street Journal. Tutti concordano sulla causa: «Una decisione del Parlamento italiano». È la storia del più efficace colpo mai sferrato contro le esecuzioni capitali in America: un veto venuto dall´estero, di fronte al quale gli Stati Uniti si scoprono impotenti.
Al centro della vicenda c´è l´uso del Penthotal nel "cocktail farmaceutico" dell´iniezione letale. Quest´ultima è di gran lunga il metodo prevalente ormai per eseguire la condanna a morte. 1.237 esecuzioni, è il numero di condanne a morte eseguite in America dal 1976, anno in cui la Corte suprema autorizzò la ripresa delle esecuzioni dopo una moratoria. 1.063 sono state eseguite con l´iniezione letale, pochissime invece con la sedia elettrica, l´impiccagione, la camera a gas o la fucilazione. Su 35 Stati Usa che eseguono le condanne a morte, tutti usano l´iniezione letale come metodo principale, e in certi casi esclusivo. Nel caso di condannati a morte da tribunali federali, per esempio, l´iniezione è l´unico metodo consentito.
Nel mix di medicine letali che vengono somministrate, un componente essenziale è il potente anestetico, obbligatorio per legge in quanto rende incosciente il condannato a morte: il Penthotal. La fornitura agli Stati che eseguono la pena capitale è un quasi monopolio, in mano alla casa farmaceutica Hospira di Lake Forest, nell´Illinois. Dal 2009 manca il principio attivo essenziale per produrre il Penthotal nel laboratorio principale della North Carolina. Così, di fronte alla penuria, Hospira aveva deciso di approvvigionare le carceri americane dal suo stabilimento italiano di Liscate. Ma in seguito a un´inchiesta di Repubblica, quella strada è diventata impraticabile. Così ha spiegato Dan Rosenberg, portavoce della Hospire: «Di fronte alla richiesta del Parlamento italiano che quel farmaco sia usato solo per scopi medicinali, non possiamo continuare a rifornire dall´Italia il Dipartimento delle Pene Usa che lo utilizza per le esecuzioni. Non possiamo correre il rischio di esporre i nostri dipendenti italiani ad eventuali responsabilità legali».
A questo punto gli Stati e il Dipartimento federale delle Pene devono avviare un iter complesso per trovare fornitori alternativi, o farmaci sostitutivi, con tutti gli ostacoli che emergeranno. Gli avversari della pena di morte, infatti, possono fare ricorso in tribunale contro la legalità delle soluzioni di ripiego, guadagnando tempo. È quel che sta accadendo in Oklahoma: la decisione di quello Stato di sostituire il Penthotal col Pentobarbital, analgesico usato per l´eutanasia degli animali domestici, è stata subito impugnata e sarà oggetto di lunghe battaglie giudiziarie. «Per certi Stati questo significa bloccare tutto in un´attesa indefinita», spiega Richard Dieter del Death Penalty Information Center. «Sta crollando tutto il sistema», sostiene Diann Rust-Tierney della National Coalition to Abolish the Death Penalty.
Oggi ci sono 3.261 condannati a morte in attesa di esecuzione in tutti gli Stati Uniti. Il Texas, lo Stato col maggior numero di condanne, ha quattro esecuzioni in calendario: due a febbraio, una a maggio, una a luglio, ma ha solo due dosi residue di Penthotal. Arizona, California, Kentucky e Tennessee hanno già dovuto rinviare alcune esecuzioni per mancanza del farmaco. La Hospira non sembra molto cooperativa: il Penthotal rappresenta solo lo 0,2% del suo fatturato, ed è fonte di una pubblicità sgradita alla casa farmaceutica.
L´esempio italiano sta facendo scuola. La Gran Bretagna ha messo al bando le esportazioni di Penthotal dai suoi laboratori farmaceutici verso gli Stati Uniti. E la Commissione europea starebbe studiando un veto per tutta l´Unione. La Sandoz, che fa capo al gruppo tedesco Novartis, ha deciso di vietare le vendite a chiunque possa rifornire gli Stati Uniti. Clive Stafford Smith, che dirige la campagna inglese Reprieve contro la pena capitale, ammette che «in 26 anni di mobilitazioni non si era mai visto un risultato così efficace, ottenuto prendendo di mira un´azienda farmaceutica».
